This Agreement is a legal contract between you (“you” or “your”) and The Real Estate and Development Group, LLC, doing business as The RED Group (“we,” “us,” or “our”), governing your access to and use of our websites, digital platforms, and related services (collectively, the “Services”).

By accessing or using our Services, creating an account, or clicking any button indicating your acceptance, you agree to be bound by this Agreement. If you do not agree, do not use our Services.

1. About Our Services

The RED Group is a vertically integrated real estate firm offering property management, brokerage, design, and development services. This Agreement applies only to the Services provided by The RED Group and does not extend to services offered by unrelated third parties or service providers.

2. License and Access

Subject to your compliance with this Agreement, we grant you a limited, revocable, non-exclusive license to access and use the Services for lawful, personal, or business use. All content on the Services is owned or licensed by us and is protected by applicable intellectual property laws.

You agree not to:

• Copy, modify, distribute, or resell any content from the Services without permission.

• Access the Services using automated means, including bots or scrapers.

• Reverse engineer, decompile, or disassemble any part of the Services.

• Use the Services for illegal or unauthorized purposes.

3. User Accounts

If you register for an account, you agree to provide accurate and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Communications & Consent

By using our Services, you consent to receive communications from us electronically and by phone or SMS, including for marketing purposes, subject to your ability to opt out. You acknowledge that such communications may use automated technology.

5. Data & Privacy

You agree that we may collect and use data in accordance with our Privacy Policy. You are responsible for any content or data you submit through the Services and warrant that you have the right to do so.

6. Third-Party Services

Some functionality may involve third-party tools, software, or content. We are not responsible for any third-party services or materials accessed through the Services.

7. AI and Automation

Some portions of our Services may incorporate automated tools or artificial intelligence (AI). By using these features, you acknowledge the limitations of AI and agree not to rely on them for decisions without appropriate due diligence.

8. Fees & Transactions

Any fees for services will be disclosed prior to purchase. All transactions are final unless stated otherwise. You are responsible for any taxes related to your use of our Services.

9. Termination

We may suspend or terminate your access to the Services at any time for any reason. Upon termination, your rights to use the Services will cease immediately.

10. Disclaimers & Limitation of Liability

The Services are provided “as is.” We make no warranties about the accuracy, reliability, or availability of the Services. To the fullest extent permitted by law, we disclaim all liability for any damages resulting from your use of the Services.

11. Dispute Resolution

Any disputes will be resolved through binding arbitration in the state of Georgia, pursuant to the rules of the American Arbitration Association. You waive the right to participate in class actions or class arbitrations.

12. Modifications

We may modify this Agreement at any time by posting the revised version on our website. Your continued use of the Services after changes become effective constitutes acceptance.
